These Terms & Conditions of Sale (“Terms of Sale”) apply to purchases made directly through ivankyo.com and any other VANKYO-operated online store that links to these Terms.

Throughout these Terms of Sale, “VANKYO,” “we,” “us,” and “our” refer to VANKYO. “You” and “your” refer to the person placing an order or purchasing a product.

By placing an order through our online store, you acknowledge that you have read, understood, and agree to these Terms of Sale.

Your access to and use of ivankyo.com are also governed by the VANKYO Terms of Service and Privacy Policy.

1. Scope

These Terms of Sale apply only to products purchased directly through an eligible VANKYO-operated online store.

Products purchased through Amazon, Walmart, eBay, another online marketplace, an authorized retailer, or any other third-party seller are subject to the sales, payment, shipping, return, and refund policies of the original seller.

VANKYO may still provide eligible warranty support for products purchased from an authorized retailer, subject to the VANKYO Warranty Policy.

These Terms of Sale should be read together with the following policies:

  • Terms of Service;

  • Privacy Policy;

  • Shipping Policy;

  • Return & Refund Policy;

  • Warranty Policy; and

  • Any applicable promotion-specific or product-specific terms.

If these Terms of Sale conflict with terms that apply specifically to a promotion, product, service, or transaction, the more specific terms will control for that matter.

2. Eligibility to Purchase

You must be at least 18 years old or the age of legal majority in your state of residence, whichever is higher, to place an order.

By placing an order, you represent that:

  • You are legally capable of entering into a binding agreement;

  • The information you provide is accurate and complete;

  • You are authorized to use the selected payment method;

  • You are purchasing the products for lawful purposes; and

  • Your purchase complies with applicable laws and these Terms of Sale.

If you place an order on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms of Sale.

3. End-User Sales

The VANKYO online store is primarily intended to sell products to end-user customers.

Unless VANKYO has approved the purchase in writing, products purchased through the online store may not be acquired for:

  • Unauthorized commercial resale;

  • Redistribution;

  • Export in violation of applicable law;

  • Use of consumer promotions for wholesale purchasing; or

  • Circumvention of product or order quantity limits.

VANKYO may limit or cancel an order if we reasonably believe it was placed for unauthorized resale, fraudulent activity, promotion abuse, or another purpose inconsistent with these Terms.

Corporate, wholesale, reseller, or bulk purchases may be subject to separate written terms.

4. Product Information

We make reasonable efforts to provide accurate and current:

  • Product descriptions;

  • Product specifications;

  • Product images;

  • Compatibility information;

  • Included accessories;

  • Pricing;

  • Availability information; and

  • Estimated shipping information.

However:

  • Product colors may appear differently depending on your display and lighting conditions;

  • Lifestyle images may include accessories or other items sold separately;

  • Projected screen images may be simulated or enhanced for presentation;

  • Packaging may change without materially changing the product;

  • Minor product improvements may be introduced during production;

  • Measurements may be rounded;

  • Performance results may be based on specified test conditions; and

  • Actual performance may vary according to the environment, setup, settings, connected equipment, network conditions, content, and usage.

Certain projector functions may require compatible third-party devices, applications, subscriptions, networks, accounts, or content services.

Third-party service availability and compatibility may change independently of VANKYO.

5. Product Changes and Substitutions

VANKYO may make minor changes to a product where necessary to:

  • Improve performance or reliability;

  • Address safety or regulatory requirements;

  • Update packaging or documentation; or

  • Replace a component with a substantially equivalent component.

We will not knowingly send a materially different product model in place of the product ordered without first communicating with you and obtaining your agreement.

If the product ordered is unavailable, we may:

  • Contact you to discuss an alternative;

  • Ask whether you would like to wait for restocking; or

  • Cancel the affected item and issue an appropriate refund.

6. Prices

The price charged for a product will generally be the price displayed during checkout when you submit the order.

Prices may change without advance notice before an order is accepted.

Unless otherwise stated, displayed product prices do not include:

  • Applicable sales tax;

  • Optional expedited shipping;

  • Optional services; or

  • Other charges clearly disclosed during checkout.

A later price reduction, coupon, promotion, or special offer does not automatically entitle you to a refund of the difference for an earlier purchase.

7. Pricing and Listing Errors

Occasionally, product information may contain a typographical, pricing, promotional, availability, or technical error.

If an obvious error affects your order, VANKYO may:

  • Contact you to confirm whether you wish to proceed using the corrected information;

  • Cancel the affected item; or

  • Cancel the order before shipment.

If payment has already been collected for an item that we cancel, we will issue an appropriate refund to the original payment method.

VANKYO will not replace an ordered product with a materially different product without your agreement.

8. Promotions and Discount Codes

Promotions, discounts, coupons, bundles, free gifts, referral benefits, and other offers may be subject to additional terms.

Unless otherwise stated:

  • Offers are available for a limited time;

  • Offers apply only to eligible products and customers;

  • Offers may be limited by region or quantity;

  • Only one discount code may be used per order;

  • Offers may not be combined;

  • Promotional benefits have no cash value;

  • Discounts cannot be applied after an order is placed; and

  • Offers are void where prohibited.

VANKYO may reject or cancel the use of a promotion where we reasonably believe there has been fraud, duplication, unauthorized resale, account manipulation, or other abuse.

If a promotional bundle or gift-with-purchase order is returned, the refund may be adjusted according to the VANKYO Return & Refund Policy and the applicable promotion terms.

9. Placing an Order

When you submit an order, you are making an offer to purchase the products in your cart under these Terms of Sale.

After submitting an order, you should receive an order confirmation email.

The order confirmation acknowledges that we received your order. It does not necessarily mean that we have accepted the order.

Please review the confirmation carefully and contact VANKYO Customer Support promptly if the order information is incorrect.

10. Order Acceptance

An order is generally accepted after:

  • Payment authorization is completed;

  • Applicable fraud and order verification is completed;

  • Product availability is confirmed; and

  • The order enters fulfillment or shipment.

We may request additional information before accepting or processing an order.

VANKYO may refuse, limit, or cancel an order before shipment where reasonably necessary, including when:

  • A product is unavailable;

  • The product or price contains an obvious error;

  • Payment cannot be authorized;

  • The billing or shipping information cannot be verified;

  • The order appears fraudulent or unauthorized;

  • The order appears intended for unauthorized resale;

  • A promotion appears to have been abused;

  • The order exceeds applicable quantity limits;

  • Delivery is not available to the supplied address; or

  • Processing the order would violate applicable law or carrier requirements.

If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

11. Payment

You authorize VANKYO and its payment service providers to charge the payment method selected during checkout for:

  • The product price;

  • Applicable taxes;

  • Optional shipping charges;

  • Optional services; and

  • Other amounts disclosed before you submit the order.

Payment methods may be processed by third-party payment providers and may be subject to their own terms and privacy policies.

VANKYO does not typically receive or store complete payment card numbers.

If a payment is declined, reversed, disputed, canceled, or identified as potentially unauthorized, VANKYO may:

  • Suspend processing;

  • Request another payment method;

  • Cancel the order;

  • Restrict the associated account; or

  • Take reasonable steps to prevent fraud or loss.

12. Sales Tax

Applicable sales tax may be calculated and collected during checkout based on:

  • The shipping destination;

  • The products ordered;

  • Applicable state and local tax requirements; and

  • Other information relevant to the transaction.

The applicable tax will be included in the order total displayed during checkout.

You are responsible for taxes or government charges that are legally payable by you and are not collected during checkout.

13. Order Changes and Cancellations

Please review your order carefully before submitting it.

If you need to change or cancel an order, contact VANKYO Customer Support as soon as possible.

We will make reasonable efforts to assist, but we cannot guarantee that an order can be changed or canceled after it has been submitted.

Once an order has entered fulfillment or has been shipped, we may no longer be able to:

  • Cancel the order;

  • Change the product;

  • Change the recipient;

  • Change the shipping address;

  • Change the shipping method; or

  • Add or remove products.

If an order cannot be canceled, you may request a return after delivery in accordance with the VANKYO Return & Refund Policy.

14. Shipping and Delivery

Shipping destinations, delivery estimates, carrier selection, address requirements, tracking, split shipments, and delivery issues are governed by the VANKYO Shipping Policy.

Eligible orders are shipped only to supported delivery addresses.

Delivery dates are estimates and are not guaranteed.

Actual delivery may be affected by:

  • Product availability;

  • Payment verification;

  • Address verification;

  • Carrier performance;

  • Severe weather;

  • Transportation disruptions;

  • Public holidays;

  • Seasonal demand;

  • Remote delivery locations; or

  • Other events outside VANKYO’s reasonable control.

15. Shipping Address

You are responsible for providing a complete and accurate shipping address.

Please verify:

  • Recipient name;

  • Street address;

  • Apartment, suite, or unit number;

  • City;

  • State;

  • ZIP Code;

  • Telephone number; and

  • Email address.

VANKYO may not be able to change a shipping address after an order enters fulfillment or is transferred to the carrier.

Additional costs resulting from an incorrect or incomplete address may be charged to the customer or deducted from an available refund where permitted by law.

16. Risk of Loss

Unless applicable law provides otherwise, responsibility for loss or damage remains with VANKYO until the order is delivered to:

  • The shipping address provided with the order; or

  • A person authorized to receive the package at that address.

If you direct the carrier to deliver the package to another location, leave it unattended, redirect it, or release a signature requirement, responsibility may transfer when the carrier completes delivery according to your instructions.

17. Inspection After Delivery

Please inspect your order promptly after delivery.

Contact VANKYO Customer Support as soon as reasonably possible if:

  • The package is visibly damaged;

  • The product is damaged;

  • The product is incorrect;

  • An included product or accessory is missing; or

  • The package appears to have been opened or tampered with.

Please keep:

  • The product;

  • The product packaging;

  • The shipping carton;

  • The shipping label;

  • Included accessories; and

  • Related delivery materials

while the issue is being reviewed.

Failure to report an issue immediately does not automatically waive any right available under the VANKYO Return & Refund Policy, Warranty Policy, or applicable law.

18. Returns, Refunds, and Exchanges

Eligible returns, refunds, exchanges, and replacements are governed by the VANKYO Return & Refund Policy.

Eligible products purchased directly through ivankyo.com may generally be returned within 30 calendar days from delivery, subject to the conditions in that Policy.

VANKYO does not apply a standard restocking fee to an eligible return that complies with the Return & Refund Policy.

Products must not be returned until VANKYO Customer Support has:

  • Reviewed the request;

  • Approved the return; and

  • Provided current return instructions.

Unauthorized returns may be refused, delayed, or returned to the sender.

Refunds are generally issued to the original payment method after the returned product has been received, inspected, and approved.

19. Warranty

Eligible VANKYO projectors are covered by a one-year warranty beginning on the original purchase date, subject to the VANKYO Warranty Policy.

The Warranty Policy explains:

  • Covered product defects;

  • Warranty exclusions;

  • Proof-of-purchase requirements;

  • Troubleshooting;

  • Product inspection;

  • Warranty shipping; and

  • Available warranty solutions.

A warranty claim does not automatically entitle the customer to a refund.

Returns based on change of mind, preference, or compatibility are governed by the Return & Refund Policy rather than the Warranty Policy.

20. Third-Party Services and Compatibility

Some VANKYO products may support or interact with third-party:

  • Operating systems;

  • Streaming services;

  • Applications;

  • Voice assistants;

  • Content providers;

  • Mobile devices;

  • Networks;

  • Accessories; or

  • Connected equipment.

Third-party services may require:

  • Internet access;

  • A separate account;

  • A subscription;

  • Compatible hardware;

  • Software updates; or

  • Acceptance of separate terms.

VANKYO does not control the continued availability, pricing, content, compatibility, security, or performance of independently operated third-party services.

A change made by a third-party provider does not automatically mean that the VANKYO product is defective.

21. Product Use

You are responsible for using VANKYO products:

  • For their intended purpose;

  • In accordance with the user manual;

  • In accordance with product warnings and safety instructions;

  • With compatible power supplies, cables, and accessories;

  • With adequate ventilation; and

  • In compliance with applicable laws.

Damage caused by misuse, unauthorized modification, improper installation, incompatible accessories, or failure to follow instructions may not be covered by the VANKYO Warranty Policy.

22. Personal Data and Accounts

Some projectors may store account information, application data, network information, preferences, or other personal data.

You are responsible for:

  • Protecting your account credentials;

  • Signing out before transferring or returning a product;

  • Removing external storage devices;

  • Resetting the product where appropriate; and

  • Backing up information you wish to retain.

Information collected through ivankyo.com is handled according to the VANKYO Privacy Policy.

Third-party applications and platforms process information according to their own privacy policies.

23. Unauthorized Returns

Do not send a product to:

  • An address printed on the original shipping carton;

  • A warehouse address found online;

  • An address used for a previous return;

  • A retailer’s address; or

  • Any address not specifically provided for the current return or warranty request.

Return locations may vary according to the order, product, issue, and fulfillment location.

VANKYO is not responsible for delays, loss, or costs resulting from an unauthorized return, except where applicable law provides otherwise.

24. Website and Service Availability

We make reasonable efforts to keep the online store available and operating properly.

However, access may occasionally be affected by:

  • Scheduled maintenance;

  • Security updates;

  • Technical problems;

  • System upgrades;

  • Payment-provider interruptions;

  • Network interruptions; or

  • Events outside our reasonable control.

VANKYO does not guarantee that the online store will be continuously available or error-free.

Website-use limitations and additional disclaimers are governed by the VANKYO Terms of Service.

25. Events Outside Our Control

VANKYO will not be responsible for a delay or failure caused by events outside our reasonable control, including:

  • Severe weather;

  • Natural disasters;

  • Fire;

  • Flood;

  • Public health emergencies;

  • Labor disputes;

  • Transportation interruptions;

  • Carrier delays;

  • Government actions;

  • Import or export restrictions;

  • Power or network failures;

  • Cybersecurity incidents affecting third parties;

  • Supply-chain disruptions; or

  • Other similar events.

Where such an event affects an accepted order, we will make reasonable efforts to:

  • Provide available updates;

  • Fulfill the order when reasonably possible;

  • Offer an alternative where appropriate; or

  • Cancel the affected order and issue an appropriate refund.

26. Disclaimers

Nothing in these Terms of Sale excludes any express warranty provided under the VANKYO Warranty Policy or any mandatory consumer right.

To the fullest extent permitted by applicable law, VANKYO does not guarantee that:

  • Every product will meet every individual preference;

  • Every third-party application or service will remain available;

  • Every network or device will be compatible;

  • Every delivery estimate will be met; or

  • Website information will always be free from minor errors.

These disclaimers do not apply where a representation, warranty, or consumer right cannot legally be excluded.

27. Limitation of Liability

To the fullest extent permitted by applicable law, VANKYO will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from a purchase or product, including:

  • Loss of use;

  • Loss of data;

  • Loss of revenue;

  • Loss of profits;

  • Business interruption; or

  • The cost of substitute equipment.

Where permitted by law, VANKYO’s total liability relating to a product or order will not exceed the amount paid for the product directly giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited, including liability arising from:

  • Fraud;

  • Willful misconduct;

  • Gross negligence where it cannot be excluded;

  • Death or personal injury where limitation is prohibited; or

  • Mandatory consumer rights.

Some states do not allow certain exclusions or limitations, so some of these provisions may not apply to you.

28. Your Consumer Rights

These Terms of Sale provide contractual rights in addition to rights you may have under applicable consumer protection laws.

Nothing in these Terms of Sale excludes, restricts, or changes a consumer right or remedy that cannot legally be excluded, restricted, or changed.

Where applicable law provides greater protection than these Terms of Sale, the applicable legal requirements will control.

29. Governing Law and Disputes

These Terms of Sale are governed by the governing-law and dispute-resolution provisions in the VANKYO Terms of Service.

Under the current VANKYO Terms of Service, these Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Nothing in these Terms deprives you of mandatory consumer protections available under the laws of your state of residence.

Before filing a formal legal claim, you and VANKYO agree to make a reasonable good-faith effort to resolve the matter informally by contacting:

Nothing in these Terms prevents either party from bringing an eligible claim in small claims court or exercising a legal right that cannot be waived.

30. Changes to These Terms

VANKYO may update these Terms of Sale to reflect changes in:

  • Our products;

  • Our online store;

  • Our order processes;

  • Our business practices;

  • Applicable law; or

  • Regulatory requirements.

When these Terms are updated, the “Last Updated” date will be revised.

Material changes will apply on a forward-looking basis. Where required by law, additional notice will be provided before material changes take effect.

The version of the Terms in effect when an order is accepted will generally apply to that transaction.

31. General Provisions

Entire Agreement

These Terms of Sale, the order confirmation, and the policies incorporated by reference constitute the agreement between you and VANKYO concerning the applicable purchase.

Severability

If any provision is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

No Waiver

A failure by VANKYO to enforce a provision does not waive the right to enforce that provision later.

Assignment

You may not assign your rights or obligations under these Terms without VANKYO’s prior written consent.

VANKYO may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or similar business transaction, subject to applicable law.

No Third-Party Beneficiaries

Except where expressly stated, these Terms do not create enforceable rights for a third party.

Section headings are provided for convenience and do not affect the interpretation of these Terms.
