The account is being used fraudulently;
The account is being used in violation of these Terms; or
Suspension is reasonably necessary to protect VANKYO, our customers, or the Services.
We make reasonable efforts to provide accurate product descriptions, specifications, images, availability information, pricing, and other content.
However:
Product colors may appear differently depending on your display, lighting, and device settings;
Product packaging may change without materially affecting the product;
Minor product improvements may be introduced during production;
Certain features may depend on compatible devices, applications, networks, accounts, software, content services, or regional availability; and
Measurements, performance figures, battery runtime, brightness, audio output, screen size, and similar information may be based on specified test conditions.
Actual results may vary according to setup, environment, connected equipment, settings, content, network conditions, and usage.
If a product page conflicts with an official specification sheet, user manual, or product-specific notice, the more specific and current product information will control.
We reserve the right to correct errors and update product information where reasonably necessary.
Prices are displayed in the currency shown on the website and may change without advance notice.
A price change does not affect an order that has already been accepted, except where:
The displayed price resulted from an obvious error;
The order is canceled with your agreement;
Applicable taxes or government charges change; or
A correction is otherwise permitted or required by law.
Promotions, coupons, discounts, gifts, bundles, and special offers:
May be available for a limited time;
May apply only to specified products or customers;
May have quantity or geographic restrictions;
May not be combined unless expressly stated;
May be subject to separate terms; and
May be modified or withdrawn before an order is accepted, where permitted by law.
Discounts and promotional benefits have no cash value unless otherwise stated.
VANKYO is not required to apply a promotion retroactively to an order placed before the promotion began or after it ended.
When you place an order, you are making an offer to purchase the products in your cart under these Terms and the policies incorporated into them.
After placing an order, you may receive an order confirmation email. This confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted.
An order is generally accepted when:
Payment has been authorized;
The order has passed applicable verification;
The product is available; and
The order enters fulfillment or shipment.
We may contact you if additional information is required to verify or process an order.
VANKYO reserves the right to refuse, limit, or cancel an order where reasonably necessary, including when:
A product is unavailable;
Pricing or product information contains an obvious error;
Payment cannot be authorized;
Billing or shipping information cannot be verified;
The order appears fraudulent or unauthorized;
The order appears intended for unauthorized resale;
The order exceeds applicable quantity limits;
A promotion appears to have been misused;
Shipping is not available to the supplied address; or
Acceptance would violate applicable law or carrier requirements.
If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.
We will make reasonable efforts to notify you using the contact information provided with the order.
You may request cancellation by contacting VANKYO Customer Support as soon as possible. Cancellation cannot be guaranteed after an order has entered fulfillment or been shipped.
Once an order has shipped, it will generally be handled under the VANKYO Return & Refund Policy.
You agree to provide accurate and complete information for purchases, including:
Your name;
Billing information;
Shipping information;
Email address;
Telephone number; and
Other information reasonably required to process the transaction.
You are responsible for reviewing order information before completing checkout.
VANKYO may not be able to change an order, product selection, recipient, shipping address, or delivery method after the order has entered fulfillment.
You authorize VANKYO and its payment service providers to charge the payment method selected during checkout for:
The price of the products;
Applicable taxes;
Shipping or optional service charges; and
Any other amount clearly disclosed before purchase.
Payment services may be provided by third parties and may be subject to additional terms and privacy policies.
VANKYO does not typically receive or store complete payment card numbers.
If a payment is declined, reversed, disputed, or identified as potentially unauthorized, we may:

Request an alternative payment method;
Cancel the order;
Restrict the associated account; or
Take other reasonable steps to prevent fraud or loss.
You remain responsible for legitimate amounts due for an order.
Applicable sales tax may be calculated and collected during checkout based on:
The shipping address;

Applicable state and local requirements; and
Other information relevant to the transaction.
You are responsible for taxes or government charges that are legally payable by you and are not collected during checkout.
Shipping destinations, estimated delivery times, available carriers, address requirements, split shipments, and delivery issues are governed by the VANKYO Shipping Policy.
Delivery estimates are provided for reference and are not guaranteed delivery dates.
Orders may be delayed because of:
Product availability;
Payment or address verification;
Carrier operations;
Severe weather;
Transportation interruptions;
Seasonal demand;
Public holidays; or
Other circumstances outside VANKYO’s reasonable control.
You are responsible for providing a complete and accurate delivery address.
Unless applicable law provides otherwise, responsibility for loss or damage remains with VANKYO until the product is delivered to the address specified in the order or received by a person authorized to accept delivery.
Returns, refunds, exchanges, replacements, and order cancellations are governed by the VANKYO Return & Refund Policy.
A product must not be returned until VANKYO Customer Support has approved the return and provided current instructions.
Sending a product to an unauthorized or outdated address may delay or prevent processing.
A refund will generally be issued to the original payment method after the returned product has been received, inspected, and approved.
Nothing in these Terms limits any return, refund, or cancellation right that cannot lawfully be excluded.
Eligible VANKYO projectors are covered under the VANKYO Warranty Policy.
The Warranty Policy explains:
The applicable warranty period;
Covered product defects;
Exclusions;
Required proof of purchase;
Troubleshooting and inspection;
Warranty shipping; and
Available warranty solutions.
A warranty claim does not automatically qualify for a refund.
Returns based on preference, compatibility, or change of mind are governed by the Return & Refund Policy rather than the Warranty Policy.
You are responsible for using VANKYO products safely and in accordance with:
The user manual;
Product warnings;
Setup instructions;
Safety information;
Applicable laws; and
Reasonable operating practices.
You should:
Use a compatible and approved power source;
Maintain adequate ventilation around the projector;
Avoid blocking ventilation openings;
Keep the product away from excessive heat, moisture, and unstable surfaces;
Use compatible cables and accessories;
Follow installation and mounting instructions; and
Stop using the product if it appears damaged or unsafe.
VANKYO is not responsible for damage caused by misuse, improper installation, unauthorized modification, incompatible accessories, or failure to follow product instructions, except where applicable law provides otherwise.
VANKYO products and Services may provide access to or compatibility with third-party:
Applications;
Operating systems;
Streaming platforms;
Voice assistants;
Payment services;
Content providers;
Websites;
Networks;
Devices; or
Other services.
Third-party services are operated independently and may require:
A separate account;
A subscription;
Internet access;
Compatible equipment;
Acceptance of separate terms; or
Consent to separate privacy practices.
The availability, content, pricing, performance, compatibility, and continued operation of third-party services are controlled by their respective providers.
VANKYO does not guarantee that a third-party service will remain available, support a particular feature, or operate in every location.
Questions and complaints concerning a third-party service should generally be directed to the relevant provider.
Subject to your compliance with these Terms, VANKYO grants you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Services for lawful, personal, and non-commercial purposes.
This license does not transfer ownership of any website content, software, trademark, design, image, text, video, graphic, or other material.
Except where expressly permitted by VANKYO or applicable law, you may not:
Copy or reproduce substantial portions of the Services;
Modify or create derivative works from website content;
Sell, sublicense, rent, or commercially exploit the Services;
Remove copyright, trademark, or proprietary notices;
Frame or mirror the website;
Reverse engineer any website feature or software;

Use VANKYO content in a way that suggests an unauthorized affiliation or endorsement.

The VANKYO name and logo;
Product names;
Trademarks;
Website design;
Text;
Product photography;
Videos;
Graphics;

Layouts;

Documentation; and
Other materials,
are owned by or licensed to VANKYO and are protected by intellectual property laws.
No right, title, or interest in this content is transferred to you except for the limited right to use the Services under these Terms.
You may not use VANKYO trademarks, product images, website content, or other intellectual property for commercial purposes without prior written permission.
The Services may allow you to submit reviews, ratings, photographs, videos, comments, questions, testimonials, or other content collectively, “User Content.”
You retain ownership of your User Content.
By submitting User Content, you grant VANKYO a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:
Host;
Store;
Reproduce;
Display;
Publish;
Translate;
Adapt for formatting;
Distribute; and
Use the User Content
in connection with operating, improving, marketing, and promoting VANKYO products and Services.
This license continues for as long as reasonably necessary for those purposes, subject to applicable privacy and consumer protection laws.
You represent that:
You own or have permission to submit the User Content;
The User Content is accurate based on your genuine experience;
The User Content does not infringe another person’s rights;
The User Content does not contain confidential information you are not permitted to disclose;
The User Content is not fraudulent, deceptive, defamatory, threatening, or unlawful; and
The User Content does not contain malicious code or unauthorized advertising.
We may remove, decline to publish, or restrict User Content that violates these Terms or applicable law.
We are not required to publish or retain any User Content.
If you voluntarily provide an idea, suggestion, product improvement proposal, or other feedback about VANKYO products or Services, you agree that VANKYO may use that feedback without restriction or payment to you.
This section does not apply to confidential information submitted under a separate written agreement.
You may not use the Services to:
Violate any applicable law or regulation;
Infringe intellectual property, privacy, publicity, or other rights;
Submit false, fraudulent, or misleading information;
Impersonate another person or misrepresent an affiliation;
Access another person’s account without authorization;
Introduce viruses, malware, harmful code, or disruptive technology;
Interfere with the operation or security of the Services;
Attempt to gain unauthorized access to systems or data;
Circumvent security, access, purchasing, or promotional controls;
Scrape, crawl, harvest, or extract data through unauthorized automated methods;
Collect personal information about another person without authorization;
Send spam or unauthorized commercial communications;
Abuse discounts, promotions, referrals, reviews, returns, refunds, or warranties;
Place orders using unauthorized payment information;
Purchase products for unauthorized resale;
Harass, threaten, defame, or harm another person;

We may continue sending transactional or service-related communications concerning:
Orders;
Shipping;
Accounts;
Returns;
Warranty service;
Product safety; or
Policy changes.
You agree that communications provided electronically may satisfy legal requirements that communications be in writing, to the extent permitted by applicable law.
Electronic communications may include:
Order confirmations;
Payment confirmations;
Shipment notices;

Return and warranty instructions;

VANKYO does not guarantee that:
The website will always be uninterrupted;
Every website feature will be error-free;
All information will remain available indefinitely;
The Services will be free from harmful components; or
Every technical issue will be corrected immediately.
These website disclaimers do not replace or reduce any express product warranty provided under the VANKYO Warranty Policy or any consumer protection right that cannot legally be excluded.
To the fullest extent permitted by applicable law, VANKYO and its affiliates, service providers, officers, directors, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:
Access to or use of the Services;
Inability to access or use the Services;
Loss of data;
Loss of revenue or profits;
Business interruption;
Loss of goodwill; or
The cost of substitute services.
Except where a different remedy is required by law, VANKYO’s total liability arising from or relating to the Services or these Terms will not exceed the greater of:
$100; or
The amount you paid to VANKYO for the product or service directly giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be limited, including liability arising from:
Fraud;
Willful misconduct;
Gross negligence where it cannot be excluded;
Death or personal injury where limitation is prohibited; or
Mandatory consumer rights.
Some states do not allow certain warranty disclaimers or limitations of incidental or consequential damages. In those states, some of the limitations above may not apply to you.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VANKYO and its affiliates, officers, employees, agents, and service providers from third-party claims, damages, liabilities, losses, and reasonable costs arising from:
Your unlawful use of the Services;
Your material breach of these Terms;
Your User Content;
Your infringement of another person’s rights; or
Fraudulent or unauthorized conduct attributable to you.
This section does not require a consumer to indemnify VANKYO for VANKYO’s own negligence, unlawful conduct, or breach of these Terms.
VANKYO may assume control of the defense of a claim subject to indemnification, and you agree to provide reasonable cooperation.
You may stop using the Services at any time.
VANKYO may suspend or terminate access to the Services if:
You materially violate these Terms;
Your use creates a security or fraud risk;
Your conduct may harm VANKYO, another user, or a third party;
We are required to act by law or legal process; or
A relevant feature or service is discontinued.
Where reasonably appropriate, we may provide notice and an opportunity to correct the violation.
Termination does not affect:
Transactions completed before termination;
Outstanding payment obligations;
Rights and obligations that by their nature should survive; or
Rights available under the Return & Refund Policy or Warranty Policy.
These Terms and your use of the Services are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.
Nothing in these Terms deprives you of mandatory consumer protections available under the laws of your state of residence.
Before filing a formal legal claim, you and VANKYO agree to make a reasonable good-faith effort to resolve the dispute informally.

These Terms do not require binding arbitration and do not waive any right to a jury trial or class proceeding that is otherwise available under applicable law.
